Price or market value: the dutiable value
Duty is charged on the car's dutiable value. In New South Wales, Victoria, Queensland, South Australia, Tasmania and the ACT that is the higher of the price you pay and the car's market value, so a private sale below the market value does not lower the duty. Western Australia and the Northern Territory charge an ordinary sale between strangers on its price. Everywhere, the value includes GST and anything sold with the car.

Questions about stamp duty on cars
How is stamp duty on a car worked out?
Each state sets its own rates and charges them on the car's dutiable value. Most charge a set amount for every hundred dollars of value (Victoria for every two hundred), Western Australia a percentage, and in most states the rate rises for dearer cars. Queensland also charges by the number of cylinders, Victoria charges less for low-emission cars and the ACT for zero-emission ones, and the Northern Territory takes part of an electric car's value off.
Is stamp duty paid on the price or the market value?
In most states, on the higher of the price you pay and the car's market value, so buying a car for less than it is worth does not lower the duty. Western Australia and the Northern Territory charge an ordinary sale between strangers on its price.
Which state has the cheapest stamp duty on cars?
On a used $30,000 petrol car, New South Wales, Queensland, Tasmania and Northern Territory are the cheapest at $900 and Victoria the dearest at $1,260. The order changes with the price, so the table on this page shows each state at several prices.
Do you pay stamp duty on a used car?
Yes. Every state and territory charges duty each time a car's registration moves to a new owner, whether the seller is a dealer or a private seller, along with a transfer fee.
Who pays stamp duty on a private car sale?
The buyer, when they transfer the registration into their name. The seller pays nothing at the transfer.
Does a dealer's price include stamp duty?
A "drive away" price does: it includes the duty, the transfer and the rego. A price marked "excl. government charges" does not.
How we work it out
Duty is worked out from each state's published rates on the value that state charges it on, and our worked examples were checked against each state's own calculator. Transfer fees and rego are the published fees; rego is an estimate for a typical private car, since the exact amount depends on the car's weight, engine and where it is kept.
